This site and the Swatchly app (the “App”) are made available to you by Swatchly LLC (“Swatchly”, “we”, “our”, or “us”) subject to these Terms of Service (the “Terms”), including those set forth in our Privacy Policy. By using or accessing the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
We may update or modify these Terms at any time. Continued use of the App after changes are made constitutes acceptance of the updated Terms.
The App is provided for your personal, non-commercial use only. You may not resell, distribute, reverse engineer, or modify any part of the App without written permission.
The current version of Swatchly does not require a user account. If future features require account creation, you must provide accurate and complete information. You are responsible for safeguarding your account credentials.
If you purchase a subscription or paid feature, your payment will be handled by Apple via the App Store. Subscriptions may automatically renew unless canceled at least 24 hours before the end of the billing period. We do not issue refunds for payments handled by third parties.
All content you enter into the app (e.g., color data, wall names, rooms) is your own. You retain full ownership of your content. Swatchly does not access, share, or use your data except as required to operate the app.
We reserve the right to suspend or terminate your access to the App at our sole discretion, especially in cases of misuse or violations of these Terms.
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. SWATCHLY LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
In no event shall Swatchly LLC be liable for any indirect, incidental, or consequential damages arising from your use of the App.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. All disputes shall be resolved in the courts located in Travis County, Texas.
